7. Participant Responsibilities
As a participant, you agree to:
- Attend sessions punctually and engage respectfully with the facilitator and any co-participants
- Use programme materials for personal educational purposes only, and not reproduce or distribute them commercially
- Inform us in advance if a session must be missed, so that arrangements can be made
- Refrain from recording sessions (audio or video) without prior written consent from Kasih Finance
- Not use our website or materials in any way that is unlawful, misleading, or disruptive
8. Intellectual Property
All content produced by Kasih Finance — including course materials, worksheets, reference cards, frameworks, slides, and website copy — is the intellectual property of Kasih Finance and is protected under Malaysian copyright law.
Upon enrolment, you are granted a personal, non-exclusive, non-transferable licence to use programme materials for your own education and financial planning purposes. This licence does not permit you to share, reproduce, teach, or commercialise these materials in any form.
If you wish to reference Kasih Finance materials in a professional or published context, please contact us in writing to discuss permitted use.
9. Educational Scope and Disclaimers
Important: Kasih Finance provides financial education, not regulated financial advice. Our programmes are designed to inform and empower participants, not to direct specific investment, insurance, legal, or tax decisions.
- Nothing in our programmes, materials, or communications constitutes personalised financial advice regulated under the Capital Markets and Services Act 2007 or any other Malaysian legislation.
- Participants are encouraged to consult with licensed financial planners, legal advisors, or tax professionals for decisions that require professional guidance.
- Any examples, case studies, or illustrative figures used in sessions are for educational purposes and do not represent specific predictions or outcomes for any individual.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Kasih Finance's total liability to any participant arising from a programme shall not exceed the total fee paid by that participant for that specific programme.
Kasih Finance shall not be liable for any indirect, incidental, or consequential loss arising from your participation in or reliance on our educational content, including but not limited to financial decisions made after attending a programme.
Nothing in these Terms limits liability for fraud, gross negligence, or personal injury caused by our staff.
11. Confidentiality
In the course of certain programmes — particularly the Integrated Retirement and Legacy Programme — you may share personal financial or family information with Kasih Finance facilitators. We treat this information with the highest level of discretion.
Any personal details shared during sessions are held in confidence and will not be disclosed to third parties without your consent, except where required by law. Please refer to our Privacy Policy for full details on how we handle personal data.
12. Termination
Kasih Finance reserves the right to terminate or suspend a participant's enrolment, without refund, if the participant engages in behaviour that is disruptive, disrespectful, or in violation of these Terms. We would take such action only as a last resort and would communicate our concerns to the participant first.
Participants may withdraw from a programme at any time, subject to the cancellation terms set out in Section 6.
13. Governing Law and Disputes
These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia, including the Contracts Act 1950 and any other relevant legislation in force.
In the event of a dispute, we encourage you to contact us directly to seek an informal resolution. Most concerns can be resolved promptly through open communication.
If informal resolution is not possible, disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia, with Petaling Jaya, Selangor as the preferred venue.
14. General Provisions
- Entire Agreement: These Terms, together with your enrolment confirmation, constitute the entire agreement between you and Kasih Finance for that programme.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Our failure to enforce a provision on one occasion does not waive our right to enforce it in the future.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our obligations to a successor entity.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our programmes, pricing, or the legal environment. The most recent version will always be available on this page, with the updated date shown prominently at the top.
Continued use of our website or participation in a programme after changes are posted constitutes your acceptance of the revised Terms. For significant changes, we will make reasonable efforts to notify enrolled participants directly.
